Affiliate Partner Program Terms

These Affiliate Partner Program Terms (“Affiliate Terms”) govern your participation in the Cabana Studio Affiliate Partner Program (the “Program”) operated by Cabana Studio (“Cabana,” “we,” “us”). By applying to, or participating in, the Program you agree to these Affiliate Terms, our Terms of Service and Privacy Policy, which are incorporated here. If there is a conflict about the Program specifically, these Affiliate Terms control. You must be at least 18 and, if you apply on behalf of a company, you represent that you can bind it.

Participation is by approval only. Creators may apply from their Cabana dashboard and companies, agencies, and communities may apply on our affiliate page. Submitting an application does not make you an affiliate - we review each application and may approve, decline, or request more information at our discretion. We may also set, change, or waive eligibility requirements at any time.

On approval you receive a personal referral link. Referrals are attributed on a first-touch basis using a cookie set when someone clicks your link, which lasts 60 days. If that person signs up and becomes a paying subscriber within the window, the referral is credited to you. Attribution is determined by our systems, and our records are the final basis for calculating commissions.

• Only signups that come through your issued affiliate link earn commission. Traffic that reaches Cabana any other way does not count - including sign-up links on your own Cabana portfolio or media-kit pages, our own marketing, organic search, or any link that is not your affiliate link. Your Cabana portfolio's sign-up button is not an affiliate link.
• Only use your own approved link; do not alter, cloak, or generate links you weren't issued.
• Clearly disclose that you are a Cabana affiliate wherever you promote us, as required by the FTC and applicable law.
• Do not present your link or offers in a way that implies Cabana employs you, endorses your other products, or that we are the source of your content.

For each approved, genuine referral who becomes a paying Cabana subscriber, you earn a one-time commission of 30%of that subscriber’s first subscription payment (before taxes and processing fees). Commissions:

• are earned only on real, arms-length referrals of new paying customers - not on your own account, accounts you control, or people you were paid or incentivized to sign up in violation of these terms;
• accrue as “owed” once the referred account activates a paid plan, and are calculated from our records;
• may be adjusted, withheld, voided, or clawed back if the underlying payment is refunded, disputed, charged back, reversed, or found to be fraudulent or in breach of these terms;
• are the only compensation under the Program - there is no recurring, lifetime, or multi-tier commission unless we state so in writing.

We may change the commission rate or structure prospectively; changes do not affect commissions already earned before the change takes effect.

We pay earned commissions on our normal payout cadence to the payout method you provide (for example, your connected Stripe account or another method we accept). You are responsible for the accuracy of your payout details and for all taxes on amounts you receive; we may require tax documentation (such as a W-9 or W-8) before paying, and may apply a minimum payout threshold. We may offset or withhold amounts reasonably necessary to cover reversals, clawbacks, or suspected fraud.

You agree not to, directly or indirectly:

• generate fake, fraudulent, self-, or incentivized-in-violation signups, or engage in cookie stuffing or any scheme to manufacture attribution;
• spam - including unsolicited email, DMs, comments, or messaging that violates CAN-SPAM or platform rules;
• bid on, or run paid search/social ads targeting, “Cabana,” “Cabana Studio,” our trademarks, or confusingly similar terms, or use paid ads that could divert our own traffic, without our prior written permission;
• make false, misleading, or unauthorized claims about Cabana, its pricing, features, or your relationship with us, or make earnings/results promises on our behalf;
• use our name, logos, or brand assets except as we permit, or register domains, handles, or accounts that impersonate Cabana;
• promote Cabana on sites or in ways that are unlawful, deceptive, or contain infringing, adult, hateful, or harmful content.

Either of us may end your participation at any time, for any reason, on notice (which may be by email or in-product). We may also suspend your link, withhold or void commissions, and remove you from the Program immediately if we believe you have violated these terms or engaged in conduct that harms Cabana, our customers, or our brand. On termination your right to use your link and our brand assets ends; we will pay commissions properly earned and not subject to reversal or clawback.

You are an independent contractor participating in a marketing program. Nothing here creates an employment, agency, partnership, joint-venture, or franchise relationship. You have no authority to bind Cabana, to make commitments on our behalf, or to represent that you are our employee or agent, and you are responsible for your own expenses and taxes.

The Program is offered at our discretion. We do not guarantee any level of traffic, conversions, or earnings, and we may modify, suspend, or discontinue the Program - or these Affiliate Terms - at any time. Your continued participation after a change takes effect is your acceptance of the updated terms.

The Program and any materials we provide are offered “as is.” To the fullest extent permitted by law, Cabana is not liable for indirect, incidental, special, or consequential damages arising from the Program, and our total liability relating to the Program will not exceed the commissions we paid or owed you in the three months before the event giving rise to the claim. The disclaimers, limitations, governing law, and dispute terms in our Terms of Service also apply to the Program.
